Terms of Use

These Terms of Use (“Terms”) govern your access to and use of The Voice of Carbon Valley website and related local-information services (the “Site”). By using the Site, creating an account, submitting a listing, or using a Voice Card or offer, you agree to these Terms and to our Privacy Policy.
Operator. The Voice of Carbon Valley is a Colorado-based local information service. In these Terms, “we,” “us,” and “our” mean the operator of The Voice of Carbon Valley. You can reach us at info@thevoiceofcarbonvalley.com.
Not legal advice. This is a practical operating document for a small community directory. It is not a substitute for review by a Colorado-licensed attorney. Have counsel review it before you accept payments, run advertising programs, or expand beyond local listings.
1. The Service
The Voice of Carbon Valley provides local business listings, community information, events, public resources, and tools for participating residents and businesses in Frederick, Firestone, Dacono, and nearby communities. We may add, change, pause, or discontinue features at any time. We do not promise uninterrupted or error-free operation.
2. Eligibility and Accounts
The Site is intended for users 18 years of age or older. If you are under 18, you may use public pages only with a parent or guardian’s permission and may not create an account or submit a listing in your own name.
If you create an account, you must provide accurate information, keep your login credentials confidential, and notify us promptly if you believe your account has been misused. You are responsible for activity that occurs under your account. You may not impersonate another person or business, claim a listing you do not own or control, or create an account for the purpose of misleading the community.
3. Information, Not a Guarantee
We work to make local information useful and reasonably accurate, but listings, hours, offers, events, maps, ticket links, public-resource information, and third-party content can change without notice and may contain errors or omissions.
The Site is not a substitute for contacting a business, government agency, utility, school district, emergency service, health professional, lawyer, or financial professional directly. In an emergency, call 911.
We do not endorse or guarantee the quality, safety, licensing, insurance, availability, pricing, inventory, accessibility, conduct, or performance of any business, organization, event, product, offer, or service listed or mentioned on the Site. You are solely responsible for deciding whether to contact a business, redeem an offer, or attend an event.
4. Voice Cards, Offers, and Events
Voice Cards, coupons, specials, and event listings are promotional tools. They do not create a contract between us and the resident, and they do not guarantee that a business will honor an offer, that inventory will exist, or that an event will occur as described.
Participating businesses are solely responsible for the terms, restrictions, availability, and lawful operation of their offers and events. If an offer is unclear, expired, or refused, resolve it with the business. We may correct, pause, or remove an offer or event that appears inaccurate, expired, misleading, or inconsistent with these Terms.
5. Your Responsibilities
You agree to:
- Provide truthful, current information.
- Use only photos, text, logos, links, and other material you have the legal right to share.
- Respect other people’s privacy and intellectual-property rights.
- Avoid impersonation, fraud, harassment, defamation, threats, or unlawful content.
- Not interfere with, scrape, harvest, reverse engineer, overload, or misuse the Site or its data.
- Not use the Site to send spam, collect emails, or build a competing database from our listings without our written permission.
- Not post content that is sexually explicit involving minors, that promotes illegal activity, or that we reasonably believe creates a safety risk.
If you submit content about another person or a minor, you represent that you have the right to do so and that the content is appropriate for a public community site.
6. Business Listings and Submissions
Businesses and organizations are responsible for keeping their profile, hours, services, pricing, offers, events, ticket links, licensing claims, and contact details accurate.
By submitting material, you grant us a worldwide, non-exclusive, royalty-free license to host, display, format, excerpt, promote, and distribute that material through the Site and related local-information features. You keep ownership of your content. You represent that you have the rights needed to grant this license and that the content is accurate and not misleading.
We may review, edit for clarity or formatting, decline, pause, or remove a listing or submission when it is inaccurate, expired, unsafe, unlawful, misleading, off-topic, or inconsistent with these Terms. Editorial placement, category, and display order are determined by us and may change. A listing on the Site is not a certification, inspection, background check, or government license.
7. Paid Memberships and Placements
Paid memberships, verified profiles, and sponsored or featured placements will be identified where appropriate. They may provide additional profile tools or visibility. They do not guarantee leads, sales, rankings, impressions, clicks, event attendance, or any business result.
Monthly renewal and cancellation
Unless a specific offer says otherwise, paid memberships renew automatically each month at the recurring price shown at checkout until the business cancels. The checkout page will clearly show the recurring charge, that the membership renews automatically, the cancellation policy, and how to cancel. By purchasing, the business agrees to the automatic monthly renewal.
A business may cancel at any time through the billing-management link or by contacting us. Cancellation takes effect at the end of the current paid billing period, so membership benefits remain available through that period and no further monthly renewal charge will be made. We will provide a written confirmation of the purchase and cancellation information that the business can retain.
Refunds
Refund requests are considered case by case. We do not promise automatic or prorated refunds for unused time after a monthly charge, except where required by law. We may issue a full or partial refund at our discretion for duplicate charges, billing or technical errors, or other unusual circumstances. If we discontinue a prepaid program through no fault of yours, we will provide a reasonable refund or credit for the unused portion unless law requires otherwise.
We may suspend or cancel a paid feature if the account violates these Terms, if payment fails, or if we discontinue the program.
8. Our Intellectual Property
The Site, including its name, logos, layout, selection and arrangement of listings, original text, and software, is owned by us or our licensors and is protected by copyright, trademark, and other laws. You may not copy the Site as a whole, republish our directory as your own, or use our name or branding in a way that suggests we endorse you, except with our written permission.
You may link to public pages of the Site in a fair, non-misleading way. You may not frame the Site or use automated tools to extract listing data for a competing product without written permission.
9. Copyright Complaints
If you believe content on the Site infringes your copyright, send a notice to info@thevoiceofcarbonvalley.com with “Copyright Notice” in the subject line. Include your name and contact information, a description of the copyrighted work, the URL or location of the material, a good-faith statement, a statement under penalty of perjury that the notice is accurate and that you are authorized to act, and your physical or electronic signature. We may remove or disable alleged infringing material and, in appropriate cases, terminate repeat infringers.
10. Third-Party Services
The Site may link to third-party websites, maps, social platforms, booking or ticket services, payment processors, and public information sources. We do not control those services and are not responsible for their content, availability, pricing, transactions, accessibility, or privacy practices. Your use of them is governed by their own terms and policies.
11. Suspension and Removal
We may suspend, restrict, correct, or remove accounts, ownership claims, listings, submissions, Voice Cards, or access when reasonably necessary to protect users, maintain accurate information, prevent fraud or abuse, comply with law, or enforce these Terms. We may do so with or without prior notice when circumstances reasonably require it.
12. Disclaimers
THE SITE AND ALL LISTINGS, OFFERS, EVENTS, MAPS, LINKS, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, secure, or free of errors, or that any listing, offer, hours, phone number, or event detail is complete or current.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY COLORADO LAW, WE AND OUR OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST BUSINESS, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR SITE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
14. Indemnification
You will defend, indemnify, and hold harmless the Site and its owners, employees, and contractors from and against claims, damages, losses, and reasonable expenses arising out of content or listings you submit, your use of the Site, your offers, events, or business operations, or your violation of these Terms or of another person’s rights.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Courts located in Weld County, Colorado, will have exclusive jurisdiction over disputes arising out of or relating to the Site or these Terms, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property or prevent misuse of the Site.
Before filing a lawsuit, you agree to email us at info@thevoiceofcarbonvalley.com with a short description of the dispute and to allow 30 days to try to resolve it informally.
16. Changes
We may update these Terms as the Site changes. The updated version will be posted on this page with a new effective date. Continued use of the Site after the effective date constitutes acceptance of the updated Terms. If you do not agree, stop using the Site. Material changes to paid programs will be communicated in a reasonable way to affected paying accounts.
17. General
- If a provision of these Terms is held unenforceable, the rest remains in effect.
- Our failure to enforce a provision is not a waiver.
- You may not assign these Terms without our consent. We may assign them in connection with a sale or transfer of the Site.
- These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site, unless a separate written agreement applies to a paid program.
